       The Committee on Environmental Preservation and Conservation
       (Evers) recommended the following:
       
    1         Senate Amendment to Amendment (612098) (with title
    2  amendment)
    3  
    4         Between lines 879 and 880
    5  insert:
    6         Section 14. Present subsection (5) of section 373.227,
    7  Florida Statutes, is redesignated as subsection (7), and new
    8  subsections (5) and (6) are added to that section, to read:
    9         373.227 Water conservation; legislative findings and
   10  intent; objectives; comprehensive statewide water conservation
   11  program requirements.—
   12         (5) In order to incentivize water conservation, if actual
   13  water use is less than permitted water use due to documented
   14  implementation of water conservation measures, including, but
   15  not limited to, those measures identified in best management
   16  practices pursuant to s. 570.93, the permitted allocation may
   17  not be modified due to such water conservation during the term
   18  of the permit. In order to promote water conservation and the
   19  implementation of measures that produce significant water
   20  savings beyond that required in a consumptive use permit, each
   21  water management district shall adopt rules providing water
   22  conservation incentives, including permit extensions.
   23         (6) For consumptive use permits for agricultural
   24  irrigation, if actual water use is less than permitted water use
   25  due to weather events, crop diseases, nursery stock
   26  availability, or changes in crop type, a district may not as a
   27  result reduce permitted allocation amounts during the term of
   28  the permit.
   29         Section 15. Subsection (5) is added to section 373.705,
   30  Florida Statutes, to read:
   31         373.705 Water resource development; water supply
   32  development.—
   33         (5) The water management districts shall promote expanded
   34  cost-share criteria for additional conservation practices, such
   35  as soil and moisture sensors and other irrigation improvements,
   36  water-saving equipment, and water-saving household fixtures.

   40         Delete line 3366
   41  and insert:
   42         certain water users; amending s. 373.227, F.S.;
   43         prohibiting water management districts from modifying
   44         permitted allocation amounts under certain
   45         circumstances; requiring the water management
   46         districts to adopt rules to promote water conservation
   47         incentives; amending s. 373.705, F.S.; requiring water
   48         management districts to promote expanded cost-share
   49         criteria for additional conservation practices;
   50         amending s. 373.233, F.S.;
