    1                        A bill to be entitled                      
    2         An act relating to certificates of need for rural
    3         hospitals; amending s. 395.6025, F.S.; revising the
    4         criteria for exempting a rural hospital or the
    5         operator of rural hospitals from the requirement to
    6         obtain a certificate of need for the construction of a
    7         replacement facility; providing an effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Section 395.6025, Florida Statutes, is amended
   12  to read:
   13         395.6025 Rural hospital replacement facilities.
   14  Notwithstanding the provisions of s. 408.036, a hospital defined
   15  as a statutory rural hospital in accordance with s. 395.602, or
   16  an a not-for-profit operator of rural hospitals, is not required
   17  to obtain a certificate of need for the construction of a
   18  replacement new hospital located in a county with a population
   19  of at least 15,000 but no more than 18,000 and a density of less
   20  than 100 30 persons per square mile, or a replacement facility,
   21  provided that the replacement, or new, facility is not located
   22  within 15 10 miles of the site of a the currently licensed rural
   23  hospital in an adjacent county and within the current primary
   24  service area. As used in this section, the term “service area”
   25  means the fewest number of zip codes that account for 75 percent
   26  of the hospital’s discharges for the most recent 5-year period,
   27  based on information available from the hospital inpatient
   28  discharge database in the Florida Center for Health Information
   29  and Policy Analysis at the Agency for Health Care
   30  Administration.
   31         Section 2. This act shall take effect July 1, 2016.
