       Senator Evers moved the following:
       
    1         Senate Amendment (with title amendment)

    3         Delete line 52
    4  and insert:
    5         (e) A dispensing organization as defined in s. 381.986 must
    6  test cannabis before it is sold or distributed to an eligible
    7  patient or the eligible patient’s legal representative. Testing
    8  of the cannabis must be performed by an independent testing
    9  laboratory. For purposes of this paragraph, the term
   10  “independent testing laboratory” means a laboratory, including
   11  the managers, employees, or contractors of the laboratory, which
   12  has no direct or indirect interest in a dispensing organization
   13  and which is accredited by the American Association for
   14  Laboratory Accreditation to test cannabis and is registered with
   15  the Department of Health. Results must be verified and signed by
   16  two dispensing organization employees. Before dispensing the
   17  cannabis, the dispensing organization must determine that the
   18  test results indicate that it is safe for human consumption and
   19  free from contaminants that are unsafe for human consumption.
   20  The independent testing laboratory must also test the cannabis
   21  for microbials, mold, pesticides, fertilizers, harmful
   22  chemicals, and toxins and the dispensing organization must make
   23  a determination that test results indicate that any presence of
   24  such substances in the cannabis is safe for human consumption
   25  before dispensing the cannabis.
   26         (f) This section does not impair the license of an approved

   31  insert:
   32         requiring a dispensing organization to test cannabis
   33         through an independent testing laboratory before it is
   34         sold or distributed; defining the term “independent
   35         testing laboratory”;
