The Committee on Appropriations (Grimsley) recommended the
following:
1 Senate Amendment (with title amendment)

3 Between lines 1167 and 1168
4 insert:
5 5. A restricted prescription drug distributor permit is not
6 required for distributions between pharmacies that each hold an
7 active permit under chapter 465, have a common ownership, and
8 are operating in a freestanding end-stage renal dialysis clinic,
9 if such distributions are made to meet the immediate emergency
10 medical needs of specifically identified patients and do not
11 occur with such frequency as to amount to the regular and
12 systematic supplying of that drug between the pharmacies. The
13 department shall adopt rules establishing when the distribution
14 of a prescription drug under this subparagraph amounts to the
15 regular and systematic supplying of that drug.

18 And the title is amended as follows:
19 Delete line 28
20 and insert:
21 prescription drug wholesale distributor permit;
22 providing that a restricted prescription drug
23 distributor permit is not required for distributions
24 between certain pharmacies; requiring the Department
25 of Business and Professional Regulation to establish
26 by rule when such distribution constitutes regular and
27 systematic supplying of a prescription drug;
