       Senator Clemens moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 340 - 366
    4  and insert:
    5  issued for the cultivation of more than 400,000 plants, and be
    6  operated by a nurseryman as defined in s. 581.011 or an
    7  individual engaged in a similar agricultural activity, including
    8  an individual that is both a recognized class member of Pigford
    9  v. Glickman, 185 F.R.D. 82 (D.D.C. 1999), or In Re Black Farmers
   10  Litig., 856 F. Supp. 2d 1 (D.D.C. 2011), and a member of the
   11  Black Farmers and Agriculturalists Association, and have been
   12  operated as a registered nursery in this state for at least 30
   13  continuous years.
   14         2. The ability to secure the premises, resources, and
   15  personnel necessary to operate as a dispensing organization.
   16         3. The ability to maintain accountability of all raw
   17  materials, finished products, and any byproducts to prevent
   18  diversion or unlawful access to or possession of these
   19  substances.
   20         4. An infrastructure reasonably located to dispense low-THC
   21  cannabis to registered patients statewide or regionally as
   22  determined by the department.
   23         5. The financial ability to maintain operations for the
   24  duration of the 2-year approval cycle, including the provision
   25  of certified financials to the department. Upon approval, the
   26  applicant must post a $5 million performance bond. However, upon
   27  a dispensing organization’s serving at least 1,000 qualified
   28  patients, the dispensing organization is only required to
   29  maintain a $2 million performance bond.
   30         6. That all owners and managers have been fingerprinted and
   31  have successfully passed a level 2 background screening pursuant
   32  to s. 435.04.
   33         7. The employment of a medical director who is a physician
   34  licensed under chapter 458 or chapter 459 to supervise the
   35  activities of the dispensing organization.
   36         (c)Upon the registration of 5,000 active qualified
