    1                        A bill to be entitled                      
    2         An act relating to the state minimum wage; amending s.
    3         448.110, F.S.; increasing the state minimum wage;
    4         prohibiting an employer from paying an employee at a
    5         rate less than the state minimum wage; removing the
    6         limitation restricting application of the state
    7         minimum wage only to individuals entitled to receive
    8         the federal minimum wage; deleting obsolete language;
    9         providing an effective date.

   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Subsection (3) and paragraph (a) of subsection
   14  (4) of section 448.110, Florida Statutes, are amended to read:
   15         448.110 State minimum wage; annual wage adjustment;
   16  enforcement.—
   17         (3) Effective May 2, 2005, Employers shall pay employees a
   18  minimum wage at an hourly rate of $15 $6.15 for all hours worked
   19  in this state Florida. An employer may not pay an employee at a
   20  rate less than the state minimum wage Only those individuals
   21  entitled to receive the federal minimum wage under the federal
   22  Fair Labor Standards Act and its implementing regulations shall
   23  be eligible to receive the state minimum wage pursuant to s. 24,
   24  Art. X of the State Constitution and this section. The
   25  provisions of ss. 213 and 214 of the federal Fair Labor
   26  Standards Act, as interpreted by applicable federal regulations
   27  and implemented by the Secretary of Labor, are incorporated
   28  herein.
   29         (4)(a) Each Beginning September 30, 2005, and annually on
   30  September 30 thereafter, the Department of Economic Opportunity
   31  shall calculate an adjusted state minimum wage rate by
   32  increasing the state minimum wage by the rate of inflation for
   33  the 12 months prior to September 1. In calculating the adjusted
   34  state minimum wage, the Department of Economic Opportunity shall
   35  use the Consumer Price Index for Urban Wage Earners and Clerical
   36  Workers, not seasonally adjusted, for the South Region or a
   37  successor index as calculated by the United States Department of
   38  Labor. Each adjusted state minimum wage rate shall take effect
   39  on the following January 1, with the initial adjusted minimum
   40  wage rate to take effect on January 1, 2006.
   41         Section 2. This act shall take effect January 1, 2017.
