       Senator Abruzzo moved the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 119 - 150
    4  and insert:
    5         Section 2. Section 327.4107, Florida Statutes, is created
    6  to read:
    7         327.4107Anchoring or mooring of vessels in recreational
    8  boating zones.—
    9         (1)A person may not anchor or moor a vessel at any time
   10  between the hours from one-half hour after sunset to one-half
   11  hour before sunrise in Lake Boca Raton in Palm Beach County.
   12         (2)A violation of this section is punishable as provided
   13  in s. 327.73(1)(y).
   14         Section 3. Paragraph (u) of subsection (1) of section
   15  327.73, Florida Statutes, is amended, and paragraph (y) is added
   16  to that section to read:
   17         327.73 Noncriminal infractions.—
   18         (1) Violations of the following provisions of the vessel
   19  laws of this state are noncriminal infractions:
   20         (u) Section 327.331, relating to divers-down warning
   21  devices flags and buoys, except for violations meeting the
   22  requirements of s. 327.33.
   23         (y)Section 327.4107, relating to the anchoring or mooring
   24  of vessels in recreational boating zones.
   25  
   26  Any person cited for a violation of any provision of this
   27  subsection shall be deemed to be charged with a noncriminal
   28  infraction, shall be cited for such an infraction, and shall be
   29  cited to appear before the county court. The civil penalty for
   30  any such infraction is $50, except as otherwise provided in this
   31  section. Any person who fails to appear or otherwise properly
   32  respond to a uniform boating citation shall, in addition to the
   33  charge relating to the violation of the boating laws of this
   34  state, be charged with the offense of failing to respond to such
   35  citation and, upon conviction, be guilty of a misdemeanor of the
   36  second degree, punishable as provided in s. 775.082 or s.
   37  775.083. A written warning to this effect shall be provided at
   38  the time such uniform boating citation is issued.
   39         Section 4. Subsection (3) of section 327.395, Florida
   40  Statutes, is amended to read:
   41         327.395 Boating safety identification cards.—
   42         (3) Any commission-approved boater education or boater
   43  safety course, course-equivalency examination developed or
   44  approved by the commission, or temporary certificate examination
   45  developed or approved by the commission must include a component
   46  regarding diving vessels, awareness of divers in the water,
   47  divers-down warning devices flags and buoys, and the
   48  requirements of s. 327.331.

   55         revising the definitions of the terms “divers-down
   56         buoy,” “divers-down flag,” and “divers-down symbol”;
   57         defining the term “divers-down warning device”;
   58         expanding the types of indicators or devices allowed
   59         to be used to signal the presence of submerged divers;
   60         specifying requirements for divers-down warning
   61         devices; creating s. 327.4107, F.S.; prohibiting
   62         anchoring or mooring of vessels between specified
   63         hours in Lake Boca Raton; amending s. 327.73, F.S.;
   64         providing penalties; amending s. 327.395,
