       The Committee on Judiciary (Mayfield) recommended the following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Section 55.035, Florida Statutes, is created to
    6  read:
    7         55.035 Prejudgment interest.—
    8         (1) In any action in which a plaintiff recovers economic
    9  damages, the court shall include interest on each component of
   10  economic damages in the final judgment.
   11         (a) For economic damages, interest accrues from the date of
   12  the loss of an economic benefit to the plaintiff.
   13         (b) Interest can only accrue on the actual amount of
   14  economic loss of the plaintiff.
   15         (2) The rate of interest applicable to this section is the
   16  rate established pursuant to s. 55.03. Interest may not accrue
   17  on the prejudgment interest awarded in the final judgment.
   18         (3) For any action to which prejudgment interest applies
   19  which is pending on July 1, 2017, or commenced thereafter, the
   20  court shall provide interest in accordance with this section,
   21  with such interest accruing from no earlier than July 1, 2017,
   22  regardless of the date when losses were incurred, the claim was
   23  made, or attorney fees or costs were paid.
   24         Section 2. This act shall take effect July 1, 2017.

   31         An act relating to prejudgment interest; creating s.

   33         a final judgment in any action in which a plaintiff
   34         recovers economic damages; specifying the date from
   35         which interest accrues; specifying the applicable
   36         interest rate; providing for applicability; providing
   37         an effective date.
