    1                        A bill to be entitled                      
    2         An act relating to health insurance coverage for
    3         enteral formulas; amending s. 627.42395, F.S.;
    4         deleting the annual coverage limit and age limit for
    5         coverage of certain food products for the treatment of
    6         certain diseases; providing an effective date.
    7          
    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Section 627.42395, Florida Statutes, is amended
   11  to read:
   12         627.42395 Coverage for certain prescription and
   13  nonprescription enteral formulas.—Notwithstanding any other
   14  provision of law, a any health insurance policy delivered or
   15  issued for delivery, to a any person in this state or a any
   16  group, blanket, or franchise health insurance policy delivered
   17  or issued for delivery in this state must shall make available
   18  to the policyholder as part of the application, for an
   19  appropriate additional premium, coverage for prescription and
   20  nonprescription enteral formulas for home use which are
   21  physician prescribed as medically necessary for the treatment of
   22  inherited diseases of amino acid, organic acid, carbohydrate, or
   23  fat metabolism as well as malabsorption originating from
   24  congenital defects present at birth or acquired during the
   25  neonatal period. Coverage for inherited diseases of amino acids
   26  and organic acids must shall include food products modified to
   27  be low protein, in an amount not to exceed $2,500 annually for
   28  any insured individual, through the age of 24. This section
   29  applies to any person or family notwithstanding the existence of
   30  any preexisting condition.
   31         Section 2. This act shall take effect July 1, 2017.
