       Senator Lee moved the following:
       
    1         Senate Amendment to Amendment (183848) (with title
    2  amendment)

    5  insert:
    6         Section 16. Paragraph (d) is added to subsection (1) of
    7  section 320.04, Florida Statutes, to read:
    8         320.04 Registration service charge.—
    9         (1)
   10         (d) For the convenience of citizens, a tax collector or a
   11  county commission in a charter county with an appointed tax
   12  collector has the authority to enter into a contract with a
   13  license plate agent for the operation of a branch office to
   14  issue and renew license tag registrations and issue motor
   15  vehicle titles. Each location shall be considered a separate
   16  license plate agent for purposes of the contract between the
   17  department, the tax collector or county commission, and the
   18  license plate agent. Each license plate agent must secure a
   19  surety bond in the amount of $250,000 to cover losses to the
   20  department in the event of theft, fraud, or noncompliance with
   21  applicable laws, rules, or established procedures governing
   22  professional services to be performed by the license plate agent
   23  under the contract. Alternatively, in lieu of a surety bond, the
   24  license plate agent may secure an insurance policy in the amount
   25  of $250,000. The insurance policy must name the department as a
   26  certificateholder and an additional insured for the entire
   27  length of the contract. The insurance policy must cover losses
   28  to the department in the event of theft, fraud, or noncompliance
   29  with applicable laws, rules, or established procedures governing
   30  professional services to be performed by the license plate agent
   31  under the contract. At the discretion of the tax collector or
   32  the county commission, the license plate agent may charge a
   33  convenience fee if the tax collector does not reduce such
   34  services at any other tax collector branch office. All
   35  nonstatutory fees charged must be separately disclosed to the
   36  customer. The contracted license plate agent shall pay to the
   37  department annually an amount sufficient to defray each license
   38  plate agent’s pro rata share of the department’s costs,
   39  including computer hardware and software, directly related to
   40  the issuance and renewal of license tag registrations and motor
   41  vehicle titles. These funds shall be deposited into the Highway
   42  Safety Operating Trust Fund in the Department of Highway Safety
   43  and Motor Vehicles. A license plate agent shall supervise its
   44  employees and agents and establish and enforce written
   45  procedures designed to prevent and detect violations of law,
   46  rule, and department policies and procedures.

   61         insurance policy, subject to certain requirements;
   62         authorizing the license plate agent to charge a
   63         convenience fee under certain circumstances; requiring
   64         all nonstatutory fees charged to be separately
   65         disclosed to the customer; requiring the contracted
   66         license plate agent to annually pay to the department
   67         an amount sufficient to defray each license plate
   68         agent’s pro rata share of certain costs of the
   69         department; requiring such costs to be deposited into
   70         a specified trust fund; requiring a license plate
   71         agent to supervise its employees and agents and
   72         establish and enforce certain written procedures;
