Senator Brandes moved the following:

5 insert:
6 Section 5. Section 705.17, Florida Statutes, is amended to
7 read:
8 705.17 Exceptions.—Sections 705.1015-705.106 do not apply
9 The provisions of ss. 705.101-705.106 of this chapter shall not
10 be applied to any personal property lost or abandoned on the
11 campus of any institution in the State University System; or on
12 premises owned or controlled by the operator of a public-use
13 airport having regularly scheduled international passenger
14 service; or, if the owner or operator of the premises elects to
15 comply with s. 705.185, on any premises located within a theme
16 park or entertainment complex, as the term is defined in s.
17 509.013(9), or operated as a zoo, a museum, or an aquarium or on
18 any premises of a public food service establishment or public
19 lodging establishment licensed under part I of chapter 509.
20 Section 6. Section 705.185, Florida Statutes, is created to
21 read:
22 705.185 Disposal of personal property lost or abandoned on
23 the premises of certain facilities.—Whenever any lost or
24 abandoned personal property is found on any premises located
25 within a theme park or entertainment complex, as the term is
26 defined in s. 509.013(9), or operated as a zoo, a museum, or an
27 aquarium; or on any premises of a public food service
28 establishment or public lodging establishment licensed under
29 part I of chapter 509, if the owner or operator of the premises
30 elects to comply with this section, any lost or abandoned
31 property must be delivered to the owner or operator of the
32 premises, who shall take charge of the property and make a
33 record of the date such property was found. If the property is
34 not claimed by the owner within 30 days after it is found, or a
35 longer period of time as may be deemed appropriate by the owner
36 or operator of the premises, the owner or operator of the
37 premises may not sell and must dispose of the property or donate
38 it to a charitable institution that is exempt from federal
39 income tax under s. 501(c)(3) of the Internal Revenue Code for
40 sale or disposal as that charitable institution deems
41 appropriate. The rightful owner of the property may reclaim the
42 property at any time before the disposition or donation of the
43 property in accordance with this section and the established
44 policies and procedures of the owner or operator of the
45 premises.

58 procedures for the disposal or donation of such
59 property; authorizing the rightful owner to claim lost
60 or abandoned property at any time before its disposal
61 or donation; amending ss. 784.046 and 784.0485, F.S.;
