       The Committee on Community Affairs (Gruters) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete everything after the enacting clause
    4  and insert:
    5         Section 1. Section 553.843, Florida Statutes, is created to
    6  read:
    7         553.843Approval of interior building envelope insulation
    8  products.—
    9         (1)In order for interior building envelope insulation
   10  products that are not subject to s. 553.842 to be approved under
   11  the Florida Building Code, manufacturers must provide current
   12  testing data, which includes the test lab where a product was
   13  tested, the test report number, and the date on which the
   14  testing took place. This testing data must conform to the
   15  current Florida Building Code as it relates to the standards for
   16  individual insulation products, must meet standards set forth by
   17  the American Society for Testing and Materials, and must comply
   18  with the Federal Trade Commission’s regulations in 16 C.F.R.
   19  part 460.
   20         (2)Such testing data must be provided to building code
   21  officials and building professionals upon request. Evaluation
   22  reports may only be used as supporting documentation to the
   23  testing data. The report must be for a single product and must
   24  contain the test lab where a product was tested, the test report
   25  number, and the date on which the testing took place. The test
   26  lab must be accredited by a national organization such as the
   27  American Association for Laboratory Accreditation (A2LA) or the
   28  National Voluntary Laboratory Accreditation Program of the
   29  National Institute of Standards and Technology.
   30         (3)Failure to comply with this section constitutes a
   31  violation of the Florida Deceptive and Unfair Trade Practices
   32  Act under part II of chapter 501.
   33         Section 2. This act shall take effect July 1, 2019.

   43         insulation products under the Florida Building Code;
   44         requiring the manufacturer to provide the testing data
   45         to certain persons upon request; specifying that
   46         evaluation reports may only be used for certain
   47         purposes; providing requirements for evaluation
   48         reports; requiring the testing lab to have a certain
   49         accreditation; specifying that failure to provide the
   50         testing data is a violation of the Florida Deceptive
   51         and Unfair Trade Practices Act; providing an effective
   52         date.
