       Senator Rodriguez moved the following:
       
    1         Senate Amendment to Senate Amendment (406006) to House
    2  Amendment (with title amendment)
    3  
    4         Delete lines 150 - 164
    5  and insert:
    6         (5)A state entity, local governmental entity, or law
    7  enforcement agency implementing this chapter has an affirmative
    8  duty to inquire as to whether a person is a victim of or a
    9  witness to a criminal offense, and, if so, the victim or the
   10  witness may not be subject to this chapter.

   13  And the title is amended as follows:
   14         Delete lines 274 - 277
   15  and insert:
   16         circumstances; providing that certain entities or
   17         agencies have an affirmative duty to inquire as to
   18         whether a person is a victim of or a witness to a
   19         criminal offense, and, if so, exempting the person
   20         from being subject to the act; providing
