       The Committee on Judiciary (Lee) recommended the following:
       
    1         Senate Amendment 
    2  
    3         Delete lines 163 - 169
    4  and insert:
    5  sub-subparagraph a., the property owner may bring a claim
    6  against the governmental entity as provided in paragraph (4)(a)
    7  after the enactment of the law or regulation if the law’s or
    8  regulation’s effect on the real property is clear and
    9  unequivocal in its terms. In such cases, a property owner is not
   10  required to submit a formal application for development or to
   11  proceed through any formal application process if such action
   12  would be futile.
