       The Committee on Appropriations (Bean) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 141 - 173
    4  and insert:
    5  insurance policy that provides major medical coverage and
    6  coverage for organ transplants and that is delivered, issued, or
    7  renewed on or after July 1, 2020, in this state by an insurer
    8  may not deny coverage for an organ transplant solely on the
    9  basis of an insured’s disability. This section may not be
   10  construed to require such insurer to provide coverage for an
   11  organ transplant that is not medically necessary. For purposes
   12  of this section, the terms “disability” and “organ transplant”
   13  have the same meaning as in s. 765.523.
   14         Section 3. Section 627.65736, Florida Statutes, is created
   15  to read:
   16         627.65736Coverage for organ transplants.—A group health
   17  insurance policy that provides major medical coverage and
   18  coverage for organ transplants and that is delivered, issued, or
   19  renewed on or after July 1, 2020, in this state by an insurer
   20  may not deny coverage for an organ transplant solely on the
   21  basis of an insured’s disability. This section may not be
   22  construed to require such insurer to provide coverage for an
   23  organ transplant that is not medically necessary. For purposes
   24  of this section, the terms “disability” and “organ transplant”
   25  have the same meaning as in s. 765.523.
   26         Section 4. Paragraph (g) is added to subsection (5) of
   27  section 627.6699, Florida Statutes, to read:
   28         627.6699 Employee Health Care Access Act.—
   29         (5) AVAILABILITY OF COVERAGE.—
   30         (g) A health benefit plan covering small employers which is
   31  delivered, issued, or renewed on or after July 1, 2020, must
   32  comply with s. 627.65736.
   33         Section 5. Section 641.31075, Florida Statutes, is created
   34  to read:
   35         641.31075Coverage for organ transplants.—A health
   36  maintenance contract that provides major medical coverage and
   37  coverage for organ transplants and that is delivered, issued, or
   38  renewed on or after July 1, 2020, in this state by a health
   39  maintenance organization may not deny coverage for an organ
   40  transplant solely on the basis of a subscriber’s disability.
   41  This section may not be construed to require such health
   42  maintenance organization to provide coverage for an organ
   43  transplant that is not medically necessary. For purposes of this
   44  section, the terms “disability” and “organ transplant” have the
   45  same meaning as in

   48  And the title is amended as follows:
   49         Delete lines 20 - 24
   50  and insert:
   51         health maintenance organizations, respectively, that
   52         provide major medical coverage and coverage for organ
   53         transplants from denying coverage for organ
   54         transplants solely on the basis of an individual’s
   55         disability under certain circumstances; providing
   56         construction; defining the terms “disability” and
   57         “organ transplant”; amending s. 627.6699, F.S.;
   58         requiring health benefit plans covering small
   59         employers to comply with certain provisions; providing
   60         an effective date.
