       The Committee on Health Policy (Simmons) recommended the
       following:
       
    1         Senate Amendment (with title amendment)
    2  
    3         Delete lines 27 - 34
    4  and insert:
    5  governmental health coverage, the charges from an independent,
    6  nonprofit, statistically reliable benchmarking database that has
    7  been in existence for the last 5 years and that qualifies for
    8  nonprofit status under s. 501(c)(3) of the United States
    9  Internal Revenue Code are admissible as evidence of the usual
   10  and customary medical charges. With respect to damages for
   11  future medical expenses, evidence of the reasonableness of any
   12  such medical expenses may be considered along with other
   13  relevant evidence. Usual and customary charges may not include
   14
