       Senator Gibson moved the following:
       
    1         Senate Amendment to Amendment (882296) (with title
    2  amendment)
    3  
    4         Between lines 3370 and 3371
    5  insert:
    6         Section 72. Paragraph (c) is added to subsection (7) of
    7  section 1012.34, Florida Statutes, to read:
    8         1012.34 Personnel evaluation procedures and criteria.—
    9         (7) MEASUREMENT OF STUDENT PERFORMANCE.—
   10         (c) The Legislature intends that the public interest be
   11  protected by preventing the financial enrichment of owners,
   12  operators, managers, and other affiliated parties of charter
   13  schools receiving capital outlay funding. Therefore, a charter
   14  school additionally is not eligible for a funding allocation
   15  unless the chair of the governing board and the chief
   16  administrative officer of the charter school annually certify
   17  under oath that the funds will be used solely and exclusively
   18  for constructing, renovating, or improving charter school
   19  facilities that are owned by a school district, a political
   20  subdivision of the state, a municipality, a Florida College
   21  System institution, or a state university.

   26  insert:
   27         amending s. 1012.34, F.S.; providing legislative
   28         intent; providing that a charter school is not
   29         eligible for a capital outlay funding allocation
   30         unless certain officials of the charter school
   31         annually certify under oath that funds will be used in
   32         a specified manner;
