    1                        A bill to be entitled                      
    2         An act relating to specialty license plates; amending
    3         s. 320.08058, F.S.; directing the Department of
    4         Highway Safety and Motor Vehicles to develop a Solar
    5         Power license plate; providing for distribution and
    6         use of fees collected from the sale of such plates;
    7         providing a contingent effective date.

    9  Be It Enacted by the Legislature of the State of Florida:
   10  
   11         Section 1. Subsection (85) is added to section 320.08058,
   12  Florida Statutes, to read:
   13         320.08058 Specialty license plates.—
   14         (85) SOLAR POWER LICENSE PLATES.—
   15         (a) The department shall develop a Solar Power license
   16  plate as provided in this section and s. 320.08053. The plate
   17  must bear the colors and design approved by the department. The
   18  word “Florida” must appear at the top of the plate, and the
   19  words “Powered by the Sun” must appear at the bottom of the
   20  plate.
   21         (b) The annual fees from the sale of the plate shall be
   22  distributed to Florida Solar Energy Research and Education
   23  Foundation, Inc., a nonprofit Florida corporation under s.
   24  501(c)(3) of the Internal Revenue Code, to fund its activities,
   25  programs, and projects aimed at solar workforce training,
   26  employment internships, and related activities, programs, and
   27  projects. The foundation may retain all revenue from the annual
   28  use fees until all startup costs for developing and establishing
   29  the plate have been recovered. Thereafter, up to 10 percent of
   30  the annual use fee revenue may be used for promotion and
   31  marketing of the specialty license plate and administrative
   32  costs directly associated with the corporation’s activities,
   33  programs, and projects and the specialty license plate. The
   34  foundation shall use the remaining funds as follows:
   35         1. To provide funds to the Florida Solar Energy Center for
   36  the purpose of developing and administering solar energy
   37  industry workforce training programs;
   38         2. To provide funds to federal veteran support facilities
   39  for solar demonstration projects that will lower energy costs to
   40  the veteran support facilities; and
   41         3. To provide funds to not-for-profit, educational, or
   42  charitable organizations for projects or promotional campaigns
   43  that further the goal of the growth of the use of solar energy
   44  in this state.
   45         Section 2. This act shall take effect October 1, 2020, but
   46  only if SB 958 or similar legislation takes effect, if such
   47  legislation is adopted in the same legislative session or an
   48  extension thereof and becomes a law.
