    1                        A bill to be entitled                      
    2         An act relating to prohibition of smoking and vaping
    3         in state parks; creating s. 386.2095, F.S.;
    4         prohibiting smoking and vaping within the boundaries
    5         of state parks; requiring the Department of Health to
    6         post signs at specified locations; providing sign
    7         requirements; providing penalties; amending s.
    8         386.208, F.S.; conforming a provision to changes made
    9         by the act; providing an effective date.
   10          
   11  Be It Enacted by the Legislature of the State of Florida:
   12  
   13         Section 1. Section 386.2095, Florida Statutes, is created
   14  to read:
   15         386.2095Smoking and vaping prohibited in state parks.—
   16         (1)A person may not smoke or vape within the boundaries of
   17  a state park.
   18         (2)The department shall conspicuously post at each
   19  entrance of each state park signs stating that smoking and
   20  vaping are prohibited within the boundaries of the state park.
   21  The signs must be clearly legible in a font size of at least 1
   22  inch in height and include the words “SMOKING OR VAPING WITHIN
   23  STATE PARK BOUNDARIES IS PROHIBITED BY LAW.”
   24         (3)A person who violates subsection (1) is subject to
   25  penalties as provided in s. 386.208.
   26         Section 2. Section 386.208, Florida Statutes, is amended to
   27  read:
   28         386.208 Penalties.—Any person who violates s. 386.204 or s.
   29  386.2095 commits a noncriminal violation as defined in s.
   30  775.08(3), punishable by a fine of not more than $100 for the
   31  first violation and not more than $500 for each subsequent
   32  violation. Jurisdiction shall be with the appropriate county
   33  court.
   34         Section 3. This act shall take effect July 1, 2024.
