    1                        A bill to be entitled                      
    2         An act relating to local government actions; amending
    3         ss. 125.66 and 166.041, F.S.; revising applicability
    4         provisions for the enactment or adoption of county and
    5         municipal ordinances, respectively; providing an
    6         effective date.
    7          
    8  Be It Enacted by the Legislature of the State of Florida:
    9  
   10         Section 1. Paragraph (c) of subsection (3) of section
   11  125.66, Florida Statutes, is amended to read:
   12         125.66 Ordinances; enactment procedure; emergency
   13  ordinances; rezoning or change of land use ordinances or
   14  resolutions.—
   15         (3)
   16         (c) This subsection does not apply to:
   17         1. Ordinances required for compliance with federal or state
   18  law or regulation;
   19         2. Ordinances relating to the issuance or refinancing of
   20  debt;
   21         3. Ordinances relating to the adoption of budgets or budget
   22  amendments, including revenue sources necessary to fund the
   23  budget;
   24         4. Ordinances required to implement a contract or an
   25  agreement, including, but not limited to, any federal, state,
   26  local, or private grant, or other financial assistance accepted
   27  by a county government;
   28         5. Emergency ordinances;
   29         6. Ordinances relating to procurement; or
   30         7. Ordinances enacted to implement the following:
   31         a. Part II of chapter 163, relating to growth policy,
   32  county and municipal planning, and land development regulation,
   33  including zoning, Development orders and development permits, as
   34  those terms are defined in s. 163.3164, and, development
   35  agreements, as authorized by the Florida Local Government
   36  Development Agreement Act under ss. 163.3220-163.3243 and
   37  development permits;
   38         b.Comprehensive plan amendments and land development
   39  regulation amendments initiated by an application by a private
   40  party other than the county.
   41         c.b. Sections 190.005 and 190.046;
   42         d.c. Section 553.73, relating to the Florida Building Code;
   43  or
   44         e.d. Section 633.202, relating to the Florida Fire
   45  Prevention Code.
   46         Section 2. Paragraph (c) of subsection (4) of section
   47  166.041, Florida Statutes, is amended to read:
   48         166.041 Procedures for adoption of ordinances and
   49  resolutions.—
   50         (4)
   51         (c) This subsection does not apply to:
   52         1. Ordinances required for compliance with federal or state
   53  law or regulation;
   54         2. Ordinances relating to the issuance or refinancing of

   56         3. Ordinances relating to the adoption of budgets or budget

   81         Section 3. This act shall take effect October 1, 2024.
