| 9 | Be It Enacted by the Legislature of the State of Florida: |
| 10 |

| 11 | Section 1. Subsection (3) of section 1003.455, Florida |
| 12 | Statutes, is amended to read: |
| 13 | 1003.455 Physical education; assessment.-- |
| 14 | (3) Each district school board shall provide 150 minutes |
| 15 | of physical education each week for students in kindergarten |
| 16 | through grade 5 and 225 minutes of physical education each week |
| 17 | for students in grades 6 through 8. Students enrolled in such |
| 18 | instruction shall be reported through the periodic student |
| 19 | membership surveys, and records of such enrollment shall be |
| 20 | audited pursuant to s. 1010.305. Such instruction may be |
| 21 | provided by any instructional personnel as defined in s. |
| 22 | 1012.01(2), regardless of certification, who are designated by |
| 23 | the school principal. Each district school board is encouraged |
| 24 | to provide 225 minutes of physical education each week for |
| 25 | students in grades 6 through 8. |
| 26 | Section 2. This act shall take effect July 1, 2008. |
