Senator Crist moved the following amendment:

     Senate Amendment (with title amendment)

     Between lines 97 and 98

5

insert:

     (4) A person who commits a criminal traffic offense may not

7

pay a fine in lieu of community service, if community service

8

would otherwise be required in addition to financial restitution.

9

A judge may only order a defendant to pay a fine in lieu of

10

required community service if the court finds that the

11

defendant's residence, location, or employment obligations would

12

create an undue hardship for the defendant.

And the title is amended as follows:

     On line 22, after the semicolon,

18

insert:

providing that a person who commits a criminal traffic

20

offense may not pay a fine in lieu of community service,

21

if community service would otherwise be required in

22

addition to financial restitution; providing that a  

23

person may pay a fine in lieu of community service only

24

under specified conditions;
