  1                      A bill to be entitled

  2         An act relating to agriculture; creating s.

  3         570.191, F.S.; creating the Agricultural

  4         Emergency Eradication Trust Fund; prescribing

  5         its uses; defining what constitutes an

  6         "agricultural emergency"; providing an

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Section 570.191, Florida Statutes, is

12  created to read:

13         570.191  Agricultural Emergency Eradication Trust

14  Fund.--There is created in the office of the commissioner the

15  Agricultural Emergency Eradication Trust Fund. Funds in the

16  trust fund may be made available upon certification by the

17  commissioner that an agricultural emergency exists and that

18  funds specifically appropriated for the emergency's purpose

19  are exhausted or insufficient to eliminate the agricultural

20  emergency. The term "agricultural emergency" includes, but is

21  not limited to, an unanticipated disease, insect infestation,

22  emergency wildfire situation, insufficiency of federal funds

23  to carry out the state-federal cooperative brucellosis

24  eradication program, or natural disaster that threatens

25  plants, livestock, or forest and wild lands in the state.

26         Section 2.  This act shall take effect July 1, 1998.
