  2         An act relating to agriculture; creating s.

  3         570.191, F.S.; creating the Agricultural

  4         Emergency Eradication Trust Fund; prescribing

  5         its uses; defining what constitutes an

  6         "agricultural emergency"; transferring moneys

  7         from the Agricultural Emergency Eradication

  8         Trust Fund to the Plant Industry Trust Fund for

  9         specified purposes; providing an effective

10         date.

12  Be It Enacted by the Legislature of the State of Florida:

14         Section 1.  Section 570.191, Florida Statutes, is

15  created to read:

16         570.191  Agricultural Emergency Eradication Trust

17  Fund.--There is created in the office of the commissioner the

18  Agricultural Emergency Eradication Trust Fund. Funds in the

19  trust fund may be made available upon certification by the

20  commissioner that an agricultural emergency exists and that

21  funds specifically appropriated for the emergency's purpose

22  are exhausted or insufficient to eliminate the agricultural

23  emergency. The term "agricultural emergency" means an animal

24  or plant disease, insect infestation, or plant or pest

25  endangering or threatening the horticultural, aquacultural,

26  and agricultural interests in this state.

27         Section 2.  For fiscal year 1998-1999, up to $10

28  million collected in the Agricultural Emergency Eradication

29  Trust Fund is hereby transferred to the Plant Industry Trust

30  Fund for the purposes of carrying out any existing or future

31  declared agricultural emergencies.
