  1                      A bill to be entitled

  2         An act relating to toll facilities; amending s.

  3         338.155, F.S.; exempting certain law

  4         enforcement officers from toll payments when in

  5         official vehicles on official business;

  6         providing an effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9

10         Section 1.  Subsection (1) of section 338.155, Florida

11  Statutes, is amended to read:

12         338.155  Payment of toll on toll facilities required;

13  exemptions.--

14         (1)  No persons are permitted to use any toll facility

15  without payment of tolls, except employees of the agency

16  operating the toll project when using the toll facility on

17  official state business, state military personnel while on

18  official military business, handicapped persons as provided in

19  this section, persons exempt from toll payment by the

20  authorizing resolution for bonds issued to finance the

21  facility, and persons exempt on a temporary basis where use of

22  such toll facility is required as a detour route. Any federal

23  or Florida law enforcement highway patrol officer, as defined

24  in s. 790.001(8), sheriff, deputy sheriff, or municipal police

25  officer operating an a marked official vehicle is exempt from

26  toll payment when on official law enforcement business. The

27  secretary, or the secretary's designee, may suspend the

28  payment of tolls on a toll facility when necessary to assist

29  in emergency evacuation. The failure to pay a prescribed toll

30  constitutes a noncriminal traffic infraction, punishable as a

31  moving violation pursuant to s. 318.18.
