  1                      A bill to be entitled

  2         An act relating to rulemaking authority of the

  3         Department of Environmental Protection with

  4         respect to phosphogypsum management; requiring

  5         the Department of Environmental Protection to

  6         adopt rules to ensure that phosphogypsum stack

  7         systems are operated to meet critical safety

  8         standards by January 1, 1999; providing an

  9         effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12

13         Section 1.  Phosphogypsum Management.--The Department

14  of Environmental Protection shall adopt rules to ensure that

15  temporary impoundment structures and water conveyance piping

16  systems used in the phosphogypsum industry are designed and

17  maintained to meet critical safety standards by January 1,

18  1999. The rules must require that any temporary impoundment

19  structure used in a phosphogypsum stack system together with

20  all pumps, piping, ditches, drainage conveyances, water

21  control structures, collection pools, cooling ponds, surge

22  ponds, and any other collection or conveyance system

23  associated with phosphogypsum transport, cooling water, or the

24  return of processed wastewater must be reasonably constructed

25  and operated to avoid catastrophic spills into surface or

26  ground waters. The rules must provide that a phosphogypsum

27  stack system owner maintain a log detailing the owner's

28  operating inspection schedule, results, and any corrective

29  action taken. The rules must require phosphogypsum stack

30  owners to maintain an emergency contingency plan to

  1  demonstrate the ability to mobilize equipment and manpower to

  2  respond to emerging situations at phosphogypsum stack systems.

  3         Section 2.  This act shall take effect upon becoming a

  4  law.
