13         Amendment (with title amendment) 

14         On page 1, line 29,

15  remove from the bill:  everything after the enacting clause,

16

17  and insert in lieu thereof:

18         Section 1.  The Lake Belt Mitigation Trust Fund is

19  hereby created, to be administered by the South Florida Water

20  Management District. Funds shall be credited to the trust fund

21  as provided in s. 373.4139, Florida Statutes, to be used for

22  the purposes set forth therein.

23         Section 2.  The South Florida Water Management District

24  may issue revenue bonds pursuant to s. 373.584, Florida

25  Statutes, payable from revenues from the Lake Belt Mitigation

26  fee imposed under s. 373.4139, Florida Statutes.

27         Section 3.  Net proceeds from the Lake Belt Mitigation

28  fee and any revenue bonds issued under section 2 shall be

29  deposited into the trust fund and, together with any interest

30  earned on such moneys, shall be applied to Lake Belt

31  mitigation projects as provided in s. 373.4139, Florida

 1  Statutes.

 2         Section 4.  The Lake Belt Mitigation Trust Fund is a

 3  trust fund as described in Section 19(f)(3), Article III of

 4  the State Constitution, and therefore is not subject to

 5  termination pursuant to Section 19(f)(2), Article III of the

 6  State Constitution.

 7         Section 5.  This act shall take effect July 1 of the

 8  year in which enacted, if HB 4071 or similar legislation is

 9  adopted in the same legislative session or an extension

10  thereof.

15         On page 1, lines 2-26,

16  remove from the title of the bill:  all of said lines,

17

18  and insert in lieu thereof:

19         An act relating to trust funds; creating the

20         Lake Belt Mitigation Trust Fund within the

21         South Florida Water Management District;

22         providing for sources of moneys and purposes;

23         providing an exemption from termination;

24         providing an effective date.
