18  and insert in lieu thereof:

19         Section 2.  Subsections (1), (2), and (4) of section

20  316.193, Florida Statutes, are amended to read:

21         316.193  Driving under the influence; penalties.--

22         (1)  A person is guilty of the offense of driving under

23  the influence and is subject to punishment as provided in

24  subsection (2) if the person is driving or in actual physical

25  control of a vehicle within this state and:

26         (a)  The person is under the influence of alcoholic

27  beverages, any chemical substance set forth in s. 877.111, or

28  any substance controlled under chapter 893, when affected to

29  the extent that the person's normal faculties are impaired;

30         (b)  The person has a blood-alcohol level of 0.08 or

31  more grams of alcohol per 100 milliliters of blood; or
