11  The Committee on Executive Business, Ethics and Elections

12  recommended the following amendment:

14         Senate Amendment (with title amendment) 

15         Delete everything after the enacting clause

16

17  and insert:

18         Section 1.  Subsection (5) of section 99.012, Florida

19  Statutes, is amended to read:

20         99.012  Restrictions on individuals qualifying for

21  public office.--

22         (5)(a)  A person who is a subordinate officer, deputy

23  sheriff, or police officer must need not resign effective upon

24  qualifying pursuant to chapter 99 if pursuant to this section

25  unless the person is seeking to qualify for a public office

26  which is currently held by an officer who has authority to

27  appoint, employ, promote, or otherwise supervise that person

28  and who has qualified as a candidate for reelection to that

29  office.

30         (b)  However, Upon qualifying pursuant to chapter 99, a

31  the subordinate officer, deputy sheriff, or police officer who

 1  has qualified for a public office which is not held by an

 2  officer who has authority to appoint, employ, promote, or

 3  otherwise supervise that person must take a leave of absence

 4  without pay during the period in which he or she is a

 5  candidate for office.

 6         Section 2.  This act shall take effect July 1 of the

 7  year in which enacted.

15                      A bill to be entitled

16         An act relating to candidates for public

17         office; amending s. 99.012, F.S.; requiring a

18         subordinate officer, deputy sheriff, or police

19         officer seeking to qualify for a public office

20         to resign or take a leave of absence, depending

21         on certain circumstances relating to the office

22         sought; providing an effective date.
