  1                      A bill to be entitled

  2         An act relating to the Florida Safety Belt Law;

  3         amending s. 316.614, F.S.; providing for the

  4         issuance of a warning for a first violation of

  5         the act for a specified period; eliminating a

  6         provision which requires enforcement of the act

  7         only as a secondary action; providing an

  8         effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11

12         Section 1.  Subsection (8) of section 316.614, Florida

13  Statutes, is amended to read:

14         316.614  Safety belt usage.--

15         (8)  Any person who violates the provisions of this

16  section commits a nonmoving violation, punishable as provided

17  in chapter 318; however, until October 1, 1999, enforcement of

18  the provisions of this section, for a first violation, shall

19  be by the issuance of a warning rather than citation for a

20  nonmoving violation. However, enforcement of this section by

21  state or local law enforcement agencies must be accomplished

22  only as a secondary action when a driver of a motor vehicle

23  has been detained for a suspected violation of another section

24  of this chapter, chapter 320, or chapter 322.

25         Section 2.  This act shall take effect October 1 of the

26  year in which enacted.
