12  amendment (443136):

14         Senate Amendment (with title amendment) 

15         On page 32, between lines 20 and 21,

16

17  insert:

18         Section 36.  Paragraph (c) of subsection (1) of section

19  73.092, Florida Statutes, is amended to read:

20         73.092  Attorney's fees.--

21         (1)  Except as otherwise provided in this section, the

22  court, in eminent domain proceedings, shall award attorney's

23  fees based solely on the benefits achieved for the client.

24         (c)  Attorney's fees based on benefits achieved shall

25  be awarded in accordance with the following schedule:

26         1.  Twenty-five Thirty-three percent of any benefit up

27  to $250,000; plus

28         2.  Twenty Twenty-five percent of any portion of the

29  benefit between $250,000 and $1 million; plus

30         3.  Fifteen Twenty percent of any portion of the

31  benefit exceeding $1 million.
