13         Senate Amendment (with title amendment) 

14         On page 10, between lines 17 and 18,

16  insert:

17         Section 8.  Paragraph (d) is added to subsection (2) of

18  section 240.299, Florida Statutes, to read:

19         240.299  Direct-support organizations; use of property;

20  board of directors; audit; facilities.--

21         (2)  USE OF PROPERTY.--

22         (d)  A university may not transfer public funds or

23  property to a direct-support organization or pledge public

24  funds or property to pay or guarantee the payment of any bonds

25  or other obligations issued by a direct-support organization

26  or by a unit of local government on behalf of a direct-support

27  organization.

28         Section 9.  Subsection (1) of section 240.2995, Florida

29  Statutes, is amended to read:

30         240.2995  University health services support

31  organizations.--

 1         (1)(a)  Each state university is authorized to

 2  establish university health services support organizations

 3  which shall have the ability to enter into, for the benefit of

 4  the university academic health sciences center, arrangements

 5  with other entities as providers for accountable health

 6  partnerships, as defined in s. 408.701, and providers in other

 7  integrated health care systems or similar entities.  To the

 8  extent required by law or rule, university health services

 9  support organizations shall become licensed as insurance

10  companies, pursuant to chapter 624, or be certified as health

11  maintenance organizations, pursuant to chapter 641.

12  University health services support organizations shall have

13  sole responsibility for the acts, debts, liabilities, and

14  obligations of the organization.  In no case shall the state

15  or university have any responsibility for such acts, debts,

16  liabilities, and obligations incurred or assumed by university

17  health services support organizations.

18         (b)  A university may not transfer public funds or

19  property to a university health services support organization

20  or pledge public funds or property to pay or guarantee the

21  payment of any bonds or other obligations issued by a

22  direct-support organization or by a unit of local government

23  on behalf of a direct-support organization.
