  1                      A bill to be entitled

  2         An act relating to state government; creating a

  3         Science Advisory Board; providing for

  4         qualifications and appointment of members;

  5         providing for expenses; providing duties of the

  6         board with respect to risk impact statements

  7         prepared by agencies and risk assessment

  8         issues; providing administrative duties of the

  9         Economic and Demographic Research Division of

10         the Joint Legislative Management Committee;

11         providing an appropriation; providing an

12         effective date.

14  Be It Enacted by the Legislature of the State of Florida:

15

16         Section 1.  Science Advisory Board.--

17         (1)  There is created the Science Advisory Board.

18         (2)  The board shall consist of nine members, who shall

19  collectively represent the disciplines of biostatistics,

20  exposure modeling for the fate and transport of air

21  pollutants, exposure modeling for the fate and transport of

22  water pollutants, epidemiology, human health risk assessment

23  and human toxicology, ecological risk assessment and aquatic

24  or wildlife toxicology, public health, risk communication, and

25  economics.  Each board member must have a postgraduate degree

26  in at least one of the disciplines specified in this

27  subsection, and at least 6 years of experience in the

28  discipline represented by the member on the board.  The

29  representative of the discipline of public health must be a

30  medical doctor. Preference shall be given in choosing board

31  members to individuals with knowledge of, or experience in,

  1  risk assessment procedures, if available.  Additional

  2  employment experience may be substituted for a postgraduate

  3  degree in order for a person to qualify for membership on the

  4  board.  No more than six members of the board may be employees

  5  of the state or any political subdivision of the state, or

  6  members of the faculty of a state university. No employee of

  7  the Department of Environmental Protection, the Department of

  8  Agriculture and Consumer Services, or a water management

  9  district pursuant to chapter 373, Florida Statutes, may be a

10  member of the board until 2 years following termination or

11  vacation of that person's employment with the respective

12  entity.  At least three members of the board should not be

13  principally employed by an academic institution.  At least two

14  of the initial members of the board should have served on the

15  Risk-Based Priority Council created by chapter 95-295, Laws of

16  Florida.

17         (3)  The board shall be appointed as follows:

18         (a)  The Governor shall appoint three members to the

19  board, one of whom must be an expert in biostatistics, one of

20  whom must be an expert in human health risk assessment and

21  human toxicology, and one of whom must be an expert in public

22  health and a medical doctor with at least 6 years of

23  experience in public health.

24         (b)  The President of the Senate shall appoint three

25  members of the board, one of whom must be an expert in

26  exposure modeling for the fate and transport of air

27  pollutants, one of whom must be an expert in epidemiology, and

28  one of whom must be an expert in economics.

29         (c)  The Speaker of the House of Representatives shall

30  appoint three members to the board, one of whom must be an

31  expert in exposure modeling for the fate and transport of

  1  water pollutants, one of whom must be an expert in ecological

  2  risk assessment and aquatic or wildlife toxicology, and one of

  3  whom must be an expert in risk communication.

  4         (4)  The members of the board shall serve staggered

  5  3-year terms.  To initially accomplish staggered terms, the

  6  Governor, the President of the Senate, and the Speaker of the

  7  House of Representatives shall each assign 1-year, 2-year, and

  8  3-year terms among their initial three appointees.  All

  9  subsequent appointments shall be for full 3-year terms.

10         (5)  The members of the board shall be appointed within

11  90 days after the effective date of this act.  The members of

12  the board shall select a chair and vice chair to serve 2-year

13  terms.  A vacancy on the board shall be filled in the same

14  manner as the initial appointment.

15         (6)  The board members shall receive reimbursement for

16  travel and per diem expenses incurred while engaged in the

17  business of the board as provided by section 112.061, Florida

18  Statutes.

19         (7)  The board shall:

20         (a)  Provide advice and guidance to agencies in the

21  preparation of risk impact statements and on risk assessment

22  issues.

23         (b)  Provide oversight of agency preparation of risk

24  impact statements and issue a report addressing the following

25  issues with each risk impact statement prepared:

26         1.  Whether the problem formulation, boundaries, and

27  context of the risk impact statement were reasonable and

28  appropriate.

29         2.  The adequacy of the opportunity for stakeholder

30  input and participation in the development of the risk impact

31  statement, including communication to and input from

  1  populations of special risk, including elderly, minority, and

  2  low-income persons.

  3         3.  The adequacy of the peer review process for the

  4  risk impact statement.

  5         4.  Any areas of disagreement between the agency and

  6  the board regarding development and use of the risk impact

  7  statement.

  8         (c)  Create and maintain a list of experts to perform

  9  peer review of risk impact statements.

10         (d)  Review and update, as necessary, the guidelines

11  for risk analysis prepared by the Risk-Based Priority Council.

12         (e)  Recommend to the Legislature, when necessary,

13  needed legislation in the area of risk assessment.

14         (f)  Provide advice and guidance to agencies and the

15  Legislature on the use of science and risk assessment in

16  policymaking, when requested.

17         (8)  For administrative purposes, the board is assigned

18  to the Economic and Demographic Research Division of the Joint

19  Legislative Management Committee, which shall provide staff

20  and assistance to the board.

21         Section 2.  There is hereby annually appropriated the

22  sum of $20,000 from the General Revenue Fund to the Joint

23  Legislative Management Committee to pay travel and per diem

24  expenses of the Science Advisory Board.

25         Section 3.  This act shall take effect upon becoming a

26  law.
