2 An act relating to racketeering; amending s.
3 895.02, F.S.; redefining the term "racketeering
4 activity" to include certain acts of lewdness
5 or assignation; providing a penalty; providing
6 an effective date.

8 Be It Enacted by the Legislature of the State of Florida:

10 Section 1. Paragraph (a) of subsection (1) of section
11 895.02, Florida Statutes, is amended to read:
12 895.02 Definitions.--As used in ss. 895.01-895.08, the
13 term:
14 (1) "Racketeering activity" means to commit, to
15 attempt to commit, to conspire to commit, or to solicit,
16 coerce, or intimidate another person to commit:
17 (a) Any crime which is chargeable by indictment or
18 information under the following provisions of the Florida
19 Statutes:
20 1. Section 210.18, relating to evasion of payment of
21 cigarette taxes.
22 2. Section 403.727(3)(b), relating to environmental
23 control.
24 3. Section 414.39, relating to public assistance
25 fraud.
26 4. Section 409.920, relating to Medicaid provider
27 fraud.
28 5. Section 440.105 or s. 440.106, relating to workers'
29 compensation.
30 6. Part IV of chapter 501, relating to telemarketing.

1 7. Chapter 517, relating to sale of securities and
2 investor protection.

1 Section 2. This act shall take effect October 1, 1998.

4 SENATE SUMMARY
5 Redefines the term "racketeering activity," for purposes
of the prohibition against such activity, to include
6 violations of specified sections of ch. 796, F.S.,
relating to lewdness and assignation.
