  2         An act relating to tobacco sales; amending s.

  3         569.002, F.S.; revising the definition of "any

  4         person under the age of 18"; providing an

  5         effective date.

  7  Be It Enacted by the Legislature of the State of Florida:

  8

  9         Section 1.  Subsection (7) of section 569.002, Florida

10  Statutes, is amended to read:

11         569.002  Definitions.--As used in this chapter, the

12  term:

13         (7)  "Any person under the age of 18" does not include

14  any person under the age of 18 who:

15         (a)  Has had his or her disability of nonage removed

16  under chapter 743;

17         (b)  Is in the military reserve or on active duty in

18  the Armed Forces of the United States;

19         (c)  Is otherwise emancipated by a court of competent

20  jurisdiction and released from parental care and

21  responsibility; or

22         (d)  Is acting in his or her scope of lawful employment

23  with an entity licensed under the provisions of chapter 210 or

24  this chapter; or

25         (e)  Is working in conjunction with a law enforcement

26  agency to test the compliance of dealers with this chapter.

27         Section 2.  This act shall take effect upon becoming a

28  law.
