11  Senator Jones moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 39, between lines 2 and 3,

15

16  insert:

17         Section 19.  Subsection (26) of section 334.044,

18  Florida Statutes, 1998 Supplement, is amended to read:

19         334.044  Department; powers and duties.--The department

20  shall have the following general powers and duties:

21         (26)  To provide for the conservation of natural

22  roadside growth and scenery and for the implementation and

23  maintenance of roadside beautification programs. For fiscal

24  years 1999-2000, 2000-2001, and 2001-2002, not less than 1

25  percent of the amount contracted for construction projects,

26  and for subsequent fiscal years, not less than 1.5 percent of

27  the amount contracted for construction projects shall be

28  allocated by the department to beautification programs. Except

29  where prohibited by federal law or federal regulation, and to

30  the extent practical, a minimum of 50 percent of these funds

31  shall be used to purchase large plant materials and the

 1  remaining funds shall be used to purchase other plant

 2  materials, which shall be purchased from nursery stock in this

 3  state on a uniform, competitive-bid basis. The department

 4  shall develop grades and standards for landscaping materials

 5  purchased through this process. To accomplish these

 6  activities, the department may contract with nonprofit

 7  organizations having the primary purpose of developing youth

 8  employment opportunities.
