  2         An act relating to license plates; amending ss.

  3         320.08056, 320.08058, F.S.; creating a Tampa

  4         Bay Estuary license plate; providing for the

  5         distribution of annual use fees received from

  6         the sale of such plates; providing a contingent

  7         effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10

11         Section 1.  Paragraph (z) is added to subsection (4) of

12  section 320.08056, Florida Statutes, 1998 Supplement, to read:

13         320.08056  Specialty license plates.--

14         (4)  The following license plate annual use fees shall

15  be collected for the appropriate specialty license plates:

16         (z)  Tampa Bay Estuary license plate, $15.

17         Section 2.  Subsection (26) is added to section

18  320.08058, Florida Statutes, 1998 Supplement, to read:

19         320.08058  Specialty license plates.--

20         (26)  TAMPA BAY ESTUARY LICENSE PLATES.--

21         (a)  The department shall develop a Tampa Bay Estuary

22  license plate as provided in this section. The word "Florida"

23  must appear at the top of the plate, the words "Tampa Bay

24  Estuary" must appear at the bottom of the plate, and the image

25  of a tarpon must appear on the plate.

26         (b)  The annual use fees shall be distributed to the

27  Tampa Bay Estuary Program created by s. 163.01.

28         1.  A maximum of 5 percent of such fees may be used for

29  marketing the plate.

30         2.  Twenty percent of the proceeds from the annual use

31  fee, not to exceed $50,000, shall be provided to the Tampa Bay

  1  Regional Planning Council for activities of the Agency on Bay

  2  Management implementing the Council/Agency Action Plan for the

  3  restoration of the Tampa Bay estuary, as approved by the Tampa

  4  Bay Estuary Program Policy Board.

  5         3.  The remaining proceeds must be used to implement

  6  the Comprehensive Conservation and Management Plan for Tampa

  7  Bay, pursuant to priorities approved by the Tampa Bay Estuary

  8  Program Policy Board.

  9         Section 3.  This act shall take effect July 1, 1999.
