  1                      A bill to be entitled

  2         An act relating to public school construction

  3         financing; creating a Florida School

  4         Construction Financing Commission; providing

  5         for appointment and qualifications of members;

  6         providing administrative duties of the

  7         Legislative Committee on Intergovernmental

  8         Relations; providing duties of the commission;

  9         providing for a report; providing an

10         appropriation; providing an effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  (1)  The Florida School Construction

15  Financing Commission is created, to serve through June 30,

16  2000.

17         (2)(a)  The commission is to be composed of the

18  following 15 members, who must be appointed within 30 days

19  after the effective date of this section:

20         1.  Six members selected by the Governor, none of whom

21  may be a member of the Legislature at the time of appointment,

22  as follows: one representative from a local school board, and

23  five representatives at large.

24         2.  Four members selected by the President of the

25  Senate, as follows: one member of the majority party and one

26  member of the minority party in the Senate, one representative

27  from a local school board, and one representative at large.

28         3.  Four members selected by the Speaker of the House

29  of Representatives, as follows: one member of the majority

30  party and one member of the minority party in the House of

  1  Representatives, one representative from a local school board,

  2  and one representative at large.

  3         4.  The Commissioner of Education or the commissioner's

  4  designee.

  5         (b)  Vacancies in the membership of the commission are

  6  to be filled in the same manner as the original appointments.

  7         (c)  All state agencies are directed to cooperate with

  8  and assist the commission to the fullest extent possible. All

  9  local governments are encouraged to assist and cooperate with

10  the commission as necessary.

11         (d)  The Legislative Committee on Intergovernmental

12  Relations is authorized to employ technical support and to

13  incur expenses related to the official duties of the

14  commission, and to expend funds appropriated to the committee

15  for carrying out the official duties of the commission.

16         (e)  Commission members shall not receive remuneration

17  for their services, but are entitled to be reimbursed by the

18  Legislative Committee on Intergovernmental Relations for

19  travel and per diem expenses in accordance with section

20  112.061, Florida Statutes.

21         (3)(a)  The commission shall act as an advisory and

22  recommendatory body to the Governor and the Legislature.

23         (b)  The commission shall convene its initial meeting

24  within 60 days after the effective date of this section. At

25  its initial meeting, the commission shall select a chair and

26  shall adopt rules of procedure. Thereafter, the commission

27  shall convene at the call of its chair.

28         (c)  The commission shall study alternative methods of

29  funding school construction, and the pros and cons of each

30  method of funding.

  1         (d)  The commission shall formulate tax policies that

  2  consider school construction revenue needs, the availability

  3  of alternative funding mechanisms, and other accepted

  4  tax-policy goals, including fairness and ease of

  5  administration.

  6         (e)  The commission shall issue a report to the

  7  Governor, the President of the Senate, and the Speaker of the

  8  House of Representatives, by February 1, 2000, summarizing its

  9  findings, stating its conclusions, and proposing any

10  recommended statutory changes related to the tax laws of the

11  state.

12         Section 2.  The sum of $75,000 is appropriated to the

13  Legislative Committee on Intergovernmental Relations from the

14  General Revenue Fund to be used for the Florida School

15  Construction Financing Commission.

16         Section 3.  This act shall take effect upon becoming a

17  law.

19          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
20                         Senate Bill 1328

21

22  The Committee Substitute creates the Florida School
    Construction Financing Commission to study alternative methods
23  of funding school construction and formulate alternative tax
    policies to meet school construction revenue needs. The CS
24  appropriates $75,000 of general revenue to the Legislative
    Committee on Intergovernmental Relations to provide staff
25  support to the commission and to fund travel and per diem
    expenses.
