11  Senator Jones moved the following amendment:

13         Senate Amendment (with title amendment) 

14         On page 5, line 22, through page 6, line 2, delete

15  those lines

16

17  and insert:  of paragraph (a).

18         1.  A specialty center means any development having at

19  least 50,000 square feet of leasable area, containing

20  restaurants, entertainment facilities, and specialty shops,

21  and located adjacent to a navigable water body.  Alcoholic

22  beverages sold for consumption on the premises by a vendor in

23  a specialty center may be consumed within the specialty center

24  but may not be removed from such premises.

25         2.  A specialty center also means any enclosed

26  development that has at least 170,000 square feet of leasable

27  area that is under the dominion and physical control of the

28  owner or manager of the enclosed development, containing

29  restaurants, entertainment facilities, specialty shops, and a

30  movie theater with at least 18 operating screens. Alcoholic

31  beverages sold for consumption on the premises by a vendor in

 1  a specialty center may be consumed only in designated areas

 2  within the specialty center and may not be removed from the

 3  designated area. Such designated area shall be specifically

 4  set aside by the owner or manager of the enclosed development

 5  to allow the consumption of alcoholic beverages and must be

 6  set forth in a sketch appearing on, or attached to, the

 7  application for designation as a specialty center which must

 8  be filed with and approved by the division prior to operation

 9  as a specialty center. Designation of an enclosed development

10  as a specialty center is subject to annual review by the

11  division and, if approved, may be renewed annually as

12  determined by rule.
