  1                      A bill to be entitled

  2         An act relating to transportation; amending s.

  3         334.044, F.S.; providing for the allocation of

  4         a certain percentage of each project for

  5         roadside beautification by the Department of

  6         Transportation; amending s. 335.0415, F.S.;

  7         modifying the date on which jurisdiction and

  8         responsibility for public roads is determined;

  9         providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

13         Section 1.  Subsection (26) of section 334.044, Florida

14  Statutes, 1998 Supplement, is amended to read:

15         334.044  Department; powers and duties.--The department

16  shall have the following general powers and duties:

17         (26)  To provide for the conservation of natural

18  roadside growth and scenery and for the implementation and

19  maintenance of roadside beautification programs. To accomplish

20  this, the department shall allocate to beautification no less

21  than 1 percent of the amount contracted for construction

22  projects. To the extent practical large plant materials

23  purchased from Florida-based nurserymen stock on a uniform

24  competitive-bid basis will be used. Up to 0.5 percent may be

25  used for small to medium plant material. To accomplish these

26  activities, the department may contract with nonprofit

27  organizations having the primary purpose of developing youth

28  employment opportunities.

29         Section 2.  Subsection (1) of section 335.0415, Florida

30  Statutes, is amended to read:

  1         335.0415  Public road jurisdiction and transfer

  2  process.--

  3         (1)  The jurisdiction of public roads and the

  4  responsibility for operation and maintenance within the

  5  right-of-way of any road within the state, county, and

  6  municipal road system shall be that which existed exists on

  7  June 10 July 1, 1995.

  8         Section 3.  This act shall take effect July 1, 1999.
