  1                      A bill to be entitled

  2         An act relating to victim assistance; amending

  3         s. 960.001, F.S.; providing that the victim of

  4         a crime and the state attorney, upon the

  5         victim's consent, have standing to assert the

  6         rights of the victim; providing an effective

  7         date.

  9  Be It Enacted by the Legislature of the State of Florida:

11         Section 1.  Present subsections (7) and (8) of section

12  960.001, Florida Statutes, 1998 Supplement, are redesignated

13  as subsections (8) and (9), respectively, and a new subsection

14  (7) is added to that section, to read:

15         960.001  Guidelines for fair treatment of victims and

16  witnesses in the criminal justice and juvenile justice

17  systems.--

18         (7)  The victim of a crime and the state attorney, with

19  the consent of the victim, have standing to assert the rights

20  of a crime victim which are provided by law or s. 16(b) of

21  Art. I of the State Constitution.

22         Section 2.  This act shall take effect upon becoming a

23  law.

26                          SENATE SUMMARY

27    Provides that the victim of a crime and the state
      attorney, with the victim's consent, have standing to
28    assert statutory and constitutional rights of the victim.
