  1                      A bill to be entitled
  2         An act relating to the statewide and district
  3         managed care ombudsman committees; amending s.
  4         641.65, F.S.; revising membership of the
  5         district committees; providing for travel
  6         expenses for the district committees; amending
  7         s. 641.70, F.S.; revising facility and
  8         administrative support services provided to the
  9         statewide and district committees by the Agency
10         for Health Care Administration; providing an
11         effective date.

13  Be It Enacted by the Legislature of the State of Florida:
14
15         Section 1.  Subsection (2) of section 641.65, Florida
16  Statutes, is amended and subsection (7) is added to said
17  section, to read:
18         641.65  District managed care ombudsman committees.--
19         (2)  Each district committee shall have no fewer than 9
20  members and no more than 20 16 members, including, if possible
21  at least: one physician licensed under chapter 458, one
22  physician licensed under chapter 459, one physician licensed
23  under chapter 460, and one physician licensed under chapter
24  461, one psychologist, one registered nurse, one clinical
25  social worker, one attorney, and recipients of managed care
26  services one consumer. For the members who are recipients of
27  managed care services consumer member, preference shall be
28  given to members of organized consumer or advocacy groups with
29  national or statewide membership. No member may be employed by
30  or affiliated with a managed care program.

  1         (7)  Members of the district committees shall receive
  2  no compensation, but may be reimbursed for travel expenses in
  3  accordance with s. 112.061. Travel expenses for the district
  4  committees shall be funded from the Health Care Trust Fund,
  5  created by s. 408.16.
  6         Section 2.  Subsection (2) of section 641.70, Florida
  7  Statutes, is amended to read:
  8         641.70  Agency duties relating to the Statewide Managed
  9  Care Ombudsman Committee and the district managed care
10  ombudsman committees.--
11         (2)  The Agency for Health Care Administration shall
12  provide for location of the committees in the district offices
13  and shall provide necessary training, equipment, and office
14  supplies, including, but not limited to, clerical and
15  word-processing services, photocopiers, telephone services,
16  recordkeeping, and stationery and other necessary supplies a
17  meeting place for district committees in agency offices and
18  shall provide the necessary administrative support to assist
19  the statewide committee and district committees, within
20  available resources.
21         Section 3.  This act shall take effect July 1, 1999.

24                          HOUSE SUMMARY
25
      Increases maximum membership of the district managed care
26    ombudsman committees from 16 to 20 members. Encourages,
      rather than requires, members from specified categories.
27    Provides for members who are recipients of managed care
      services. Authorizes reimbursement for district committee
28    members' travel expenses, to be funded from the Health
      Care Trust Fund. Revises duties of the Agency for Health
29    Care Administration with respect to facilities and
      administrative support services for the statewide and
30    district managed care ombudsman committees.
