  1                      A bill to be entitled

  2         An act relating to enterprise zones; creating

  3         s. 290.0069, F.S.; authorizing the Office of

  4         Tourism, Trade, and Economic Development to

  5         designate an enterprise zone in Liberty County;

  6         providing requirements with respect thereto;

  7         authorizing the Office of Tourism, Trade, and

  8         Economic Development to designate an enterprise

  9         zone in Columbia County; providing requirements

10         with respect thereto; authorizing the Office of

11         Tourism, Trade, and Economic Development to

12         designate an enterprise zone in Suwannee

13         County; providing requirements with respect

14         thereto; providing an extended application

15         period for certain businesses to claim tax

16         incentives; providing an effective date.

18  Be It Enacted by the Legislature of the State of Florida:

19

20         Section 1.  Section 290.0069, Florida Statutes, is

21  created to read:

22         290.0069  Enterprise zone designation for Liberty

23  County.--Liberty County may apply to the Office of Tourism,

24  Trade, and Economic Development for designation of one

25  enterprise zone within an area in Liberty County that is south

26  of the border between Liberty and Gadsden Counties, south of

27  Highway 12, east of Highway 271, and north of Highway 20. The

28  application must be submitted by December 31, 1999, and must

29  comply with the requirements of s. 290.0055. Notwithstanding

30  the provisions of s. 290.0065 limiting the total number of

31  enterprise zones designated and the number of enterprise zones

  1  within a population category, the Office of Tourism, Trade,

  2  and Economic Development may designate one enterprise zone

  3  under this section. The Office of Tourism, Trade, and Economic

  4  Development shall establish the initial effective date of the

  5  enterprise zone designated pursuant to this section.

  6         Section 2.  Columbia County, or Columbia County and the

  7  municipality of Lake City jointly, may apply to the Office of

  8  Tourism, Trade, and Economic Development for designation of

  9  one enterprise zone encompassing an area within the county, or

10  within both the county and the municipality. In identifying

11  the area to be nominated for designation as an enterprise

12  zone, Columbia County, or Columbia County and the municipality

13  of Lake City jointly, shall seek to maximize the strategic

14  economic development advantages resulting from the

15  intersection of Interstate 75 and Interstate 10 within

16  Columbia County. The application must be submitted by December

17  31, 1999, and must comply with the requirements of section

18  290.0055, Florida Statutes. Notwithstanding the provisions of

19  section 290.0065, Florida Statutes, limiting the total number

20  of enterprise zones designated and the number of enterprise

21  zones within a population category, the Office of Tourism,

22  Trade, and Economic Development may designate one enterprise

23  zone under this section. The Office of Tourism, Trade, and

24  Economic Development shall establish the initial effective

25  date of the enterprise zone designated pursuant to this

26  section.

27         Section 3.  Suwannee County, or Suwannee County and the

28  municipality of Live Oak jointly, may apply to the Office of

29  Tourism, Trade, and Economic Development for designation of

30  one enterprise zone encompassing an area within the county, or

31  within both the county and the municipality. In identifying

  2  zone, Suwannee County, or Suwannee County and the municipality

  7  comply with the requirements of section 290.0055, Florida

  8  Statutes. Notwithstanding the provisions of section 290.0065,

11  population category, the Office of Tourism, Trade, and

12  Economic Development may designate one enterprise zone under

13  this section. The Office of Tourism, Trade, and Economic

14  Development shall establish the initial effective date of the

16         Section 4.  Notwithstanding the time limitations

17  contained in chapters 212 and 220, Florida Statutes, relating

18  to enterprise zone tax incentives, a business that was

19  purchased in February 1992 within an area of Tampa that

20  received a designation as an enterprise zone under section

21  290.0065, Florida Statutes, effective July 1, 1995, and that

22  was eligible to receive enterprise zone tax incentives from

23  July 1, 1995, to July 1, 1998, must submit an application for

24  the tax incentives by December 1, 1999. All other requirements

25  of the enterprise zone program apply to such a business.

26         Section 5.  This act shall take effect upon becoming a

27  law.

  1          STATEMENT OF SUBSTANTIAL CHANGES CONTAINED IN
                       COMMITTEE SUBSTITUTE FOR
  2                         Senate Bill 1510

  4  The committee substitute differs substantially from Senate
    Bill 1510 in that it also allows Suwannee and Columbia
  5  counties to apply for enterprise zones and allows a business
    located in a Tampa enterprise zone to apply for tax incentives
  6  dating back to July 1, 1995.

  7  The committee substitute also removes from the bill language
    exempting Liberty County's enterprise zone application from a
  8  statutory provision that does not appear to be applicable to
    the county's circumstances.
