1 A bill to be entitled
2 An act relating to patient records; amending s.
3 455.667, F.S.; providing that in claims for
4 injuries due to medical negligence, the health
5 care provider or his or her insurer or legal
6 representative may obtain records and interview
7 certain other health care providers; providing
8 an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Subsection (19) is added to section
13 455.667, Florida Statutes, 1998 Supplement, to read:
14 455.667 Ownership and control of patient records;
15 report or copies of records to be furnished.--
16 (19) Notwithstanding any provision of law, whenever a
17 claim for personal injury or death is brought as a result of
18 alleged negligence by a health care provider as defined by s.
19 766.101(1)(b), the defendant health care provider or the
20 defendant health care provider's insurer or legal
21 representative may interview and obtain records from other
22 health care providers involved in the patient's care.
23 Section 2. This act shall take effect upon becoming a
24 law.

27 SENATE SUMMARY
28 Provides that in claims for injuries due to medical
negligence, the health care provider or his or her
29 insurer or legal representative may interview and obtain
records from any other health care provider involved in
30 the patient's care.
