17 Section 1. Paragraph (z) is added to subsection (4) of
18 section 320.08056, Florida Statutes, 1998 Supplement, to read:
19 320.08056 Specialty license plates.--
20 (4) The following license plate annual use fees shall
21 be collected for the appropriate specialty license plates:
22 (z) Lift Every Voice and Sing license plate, $20.
23 Section 2. Subsection (26) is added to section
24 320.08058, Florida Statutes, 1998 Supplement, to read:
25 320.08058 Specialty license plates.--
26 (26) LIFT EVERY VOICE AND SING.--
27 (a) The department shall develop a Lift Every Voice
28 and Sing license plate as provided in this section. The word
29 "Florida" must appear at the bottom of the plate, and the
30 words "Lift Every Voice and Sing" must appear at the top of
31 the plate.

1 (b) The annual use fees shall be distributed annually
2 to each county in the ratio that the annual use fees collected
3 by each county bears to the total fees collected for the
4 plates within the state. Each county shall distribute the
5 funds to nongovernmental, not-for-profit agencies within the
6 county, which agencies' have, as a part of their services, a
7 program which teaches abstinence from premarital sex to
8 African-American Youth.
9 1. Agencies that receive the funds must use the funds
10 for programmatic costs directly and exclusively related to the
11 program or programs that teach abstinence from premarital sex
12 to African-American Youth. However, such funds shall not be
13 used for legal expenses or capital expenditures and a maximum
14 of 10 percent shall be used for administrative expenses.
15 2. Each agency that receives such funds must submit an
16 annual audit, prepared by a certified public accountant, to
17 the county. The county may conduct a consolidated audit in
18 lieu of the annual audit. The Office of Program Policy
19 Analysis and Government Accountability shall review the
20 expenditure of funds every 3 years to ensure that funds are
21 expended in accordance with this subsection. Any unused funds
22 that exceed 10 percent of the funds received by an agency
23 during its fiscal year must be returned to the county, which
24 shall distribute them to other qualified agencies.
25 Section 3. This act shall take effect July 1, 1999.
