14         On page 66, line 12, after the period

15

16  insert:  A student determined to be limited English proficient

17  as defined in Rule 6.A6.0901 may not be retained for the

18  failure to achieve a level of reading proficiency required of

19  an English proficient pupil. This subsection does not preclude

20  the retention of such a pupil who has been provided a program

21  in conformity with the rule and the decree of the Federal

22  Court, Southern District of Florida, Case # 90-913, Lulac v.

23  FDOE, and who has failed to make reasonable progress in

24  English.
