  1                      A bill to be entitled

  2         An act relating to termination of pregnancy;

  3         creating s. 782.091, F.S.; providing that it is

  4         a felony of the second degree to destroy a

  5         fetus during parturition with premeditated

  6         intent to cause the death of the fetus;

  7         providing penalties; providing an effective

  8         date.

10  Be It Enacted by the Legislature of the State of Florida:

12         Section 1.  Section 782.091, Florida Statutes, is

13  created to read:

14         782.091  Killing of fetus.--It is unlawful to stop

15  parturition by means of complete or partial removal of the

16  intracranial contents of the fetus or the destruction of such

17  contents when perpetrated from a premeditated design to effect

18  the death of the fetus. Any person who violates this section

19  commits a felony of the second degree, punishable as provided

20  in s. 775.082, s. 775.083, or s. 775.084.

21         Section 2.  This act shall take effect upon becoming a

22  law.

27    the death of the fetus. Provides penalties.
