  1                      A bill to be entitled

  2         An act relating to workers' compensation

  3         employer exemptions; amending s. 489.115, F.S.;

  4         authorizing a construction-license applicant to

  5         receive a temporary license from the Department

  6         of Business and Professional Regulation upon

  7         submission of an exemption application issued

  8         by the Division of Workers' Compensation under

  9         the provisions of s. 440.05, F.S.; providing an

10         effective date.

12  Be It Enacted by the Legislature of the State of Florida:

13

14         Section 1.  Paragraph (a) of subsection (5) of section

15  489.115, Florida Statutes, 1998 Supplement, is amended to

16  read:

17         489.115  Certification and registration; endorsement;

18  reciprocity; renewals; continuing education.--

19         (5)(a)  As a prerequisite to the initial issuance or

20  the renewal of a certificate or registration, the applicant

21  shall submit an affidavit on a form provided by the board

22  attesting to the fact that the applicant has obtained workers'

23  compensation insurance as required by chapter 440, public

24  liability insurance, and property damage insurance for the

25  safety and welfare of the public, in amounts determined by

26  rule of the board.  The board shall by rule establish a

27  procedure to verify the accuracy of such affidavits based upon

28  a random sample method. If a license applicant has applied for

29  but not received an exemption under chapter 440, he or she may

30  submit to the board a copy of the application for an exemption

31  in lieu of an exemption and, if otherwise eligible for a

  1  certification or registration license under this section,

  2  receive a temporary license. The temporary license will expire

  3  90 days after the date it is issued. If the applicant, within

  4  that 90 days, files with the board a copy of an actual

  5  exemption issued under chapter 440, the board shall issue to

  6  the applicant a certification or registration license pursuant

  7  to this section and all applicable administrative rules. Each

  8  applicant for a certification or registration license is

  9  eligible for only one temporary license per calendar year.

10         Section 2.  This act shall take effect July 1, 1999.
