14         Senate Amendment (with title amendment) 

15         On page 1, line 17, through page 2, line 28, delete

16  those lines

18  and insert:

19         Section 56.  Subsection (3) is added to section

20  458.309, Florida Statutes, 1998 Supplement, to read:

21         458.309  Authority to make rules.--

22         (3)  All physicians who perform level II procedures

23  lasting more than 5 minutes and who perform any level III

24  surgical procedures in an office setting must register the

25  office with the department unless that office is licensed as a

26  facility pursuant to chapter 395. The department shall inspect

27  the physician's office annually unless the office is

28  accredited by a nationally recognized accrediting agency or an

29  accrediting organization subsequently approved by the Board of

30  Medicine. The actual costs for registration and inspection or

31  accreditation shall be paid by the person seeking to register
