1 A bill to be entitled
2 An act relating to use of right-of-way for
3 utilities; amending s. 337.401, F.S.; excluding
4 pay telephone service providers from a
5 definition of telecommunications company;
6 excepting from certain requirements the
7 provision of pay telephone service on certain
8 property; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Subsection (9) of section 337.401, Florida
13 Statutes, 1998 Supplement, is amended, and subsection (10) is
14 added to said section, to read:
15 337.401 Use of right-of-way for utilities subject to
16 regulation; permit; fees.--
17 (9) As used in this section, "telecommunications
18 company" has the same meaning as defined in s. 364.02 except
19 that the term does not include pay telephone service
20 providers.
21 (10) This section, except subsection (6), does not
22 apply to the provision of pay telephone service on public
23 roads or rights-of-way or on municipal property.
24 Section 2. This act shall take effect upon becoming a
25 law.
